These Terms of Service ("Terms") govern your use of the ClearGuard: AI Photo Cleaner mobile application ("the App", "we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Service Description
1.1 What the App Does
ClearGuard: AI Photo Cleaner is an iOS utility app that helps you manage device storage by:
- Photo cleaning: Identifying duplicate photos, similar photos, screenshots, blurry images, and large videos
- Contact management: Finding duplicate or incomplete contact entries
- Calendar cleanup: Identifying expired calendar events
- Video compression: Reducing video file sizes while maintaining quality
- Private space: Encrypting and securing sensitive files with biometric authentication
- Live Photo conversion: Converting Live Photos to standard photos or videos
1.2 How It Works
The App processes photos, contacts, and calendar data locally on your device using computer vision and comparison algorithms. Analysis results are presented to you, and you decide which items to delete. We do not upload your photos, contacts, or calendar data to any server.
1.3 Free vs. Subscription Features
Free version:
- Limited photo analysis (up to 50 photos)
- Basic duplicate detection
- Preview of similar photos
Premium subscription unlocks:
- Unlimited photo and video analysis
- Advanced duplicate detection with AI similarity matching
- Video compression tools
- Private space with biometric lock
- Contact and calendar cleaning

2. Subscription Terms
2.1 Subscription Plans

2.2 Payment and Billing
- Subscriptions are billed through your Apple ID and charged to your Apple ID payment method
- Payment is charged at the time of purchase confirmation
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours before the end of the current period
- You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase
2.3 Free Trials
If we offer a free trial:
- The trial duration will be clearly displayed before you subscribe
- You can cancel anytime during the trial period without charge
- If you do not cancel before the trial ends, you will be charged for the first billing period
- Free trials are available once per Apple ID per subscription type
2.4 Cancellation and Refunds
- To cancel: Go to iOS Settings → [Your Name] → Subscriptions → ClearGuard → Cancel Subscription
- Cancellation takes effect at the end of the current billing period
- You will retain premium access until the end of the paid period
- Refunds: All sales are final and processed by Apple. We do not control Apple's refund policy. To request a refund, visit https://reportaproblem.apple.com
- If Apple approves a refund, your subscription will be immediately cancelled
2.5 Subscription Changes
We reserve the right to:
- Change subscription prices with 30 days' notice (existing subscribers are grandfathered at their current price until renewal)
- Modify features included in subscription plans
- Discontinue subscription plans (existing subscribers will be notified 60 days in advance)
3. User Responsibilities
3.1 Age Requirement
You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent.
3.2 Prohibited Uses
You agree not to:
- Use the App for any illegal purpose or in violation of any local, state, national, or international law
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
- Remove, circumvent, or disable any security features or access controls
- Use automated scripts, bots, or tools to interact with the App
- Attempt to gain unauthorized access to our servers or systems
- Upload or transmit viruses, malware, or any malicious code
- Use the App to harass, abuse, or harm others
- Misrepresent your identity or impersonate others
3.3 Account Security
- You are responsible for maintaining the security of your Apple ID
- You are responsible for all activity that occurs under your Apple ID
- If you believe your account has been compromised, contact Apple Support immediately
3.4 Data Backup
Important: Before deleting photos, videos, contacts, or calendar events using the App, ensure you have backups. Deleted items may be permanently unrecoverable after 30 days (the standard iOS "Recently Deleted" retention period). We are not responsible for accidental or unintended deletions.
4. Intellectual Property
4.1 App Ownership
The App, including its design, code, algorithms, user interface, graphics, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
4.2 Your Content
You retain all ownership rights to photos, videos, contacts, and other data you process using the App. We do not claim any ownership or rights to your content. By using the App, you grant us a limited license to process your content locally on your device only to provide the App's functionality.
4.3 Feedback
If you provide feedback, suggestions, or ideas about the App, you grant us the right to use this feedback without compensation or attribution.
5. Disclaimers
5.1 No Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- That the App will be error-free, secure, or uninterrupted
- That analysis results will be accurate or complete
- That the App will be compatible with future iOS versions
5.2 Not Professional Advice
The App is a consumer utility tool. It is not:
- Professional data recovery software
- A replacement for iCloud backups or device storage expansion
- A guarantee of device performance improvement
5.3 Third-Party Services
The App relies on third-party services (Apple Photos framework, StoreKit, etc.). We are not responsible for:
- Changes to iOS APIs that affect app functionality
- Apple's App Store policies or payment processing
- Third-party service outages or changes
6. Limitation of Liability
6.1 Scope of Liability
To the maximum extent permitted by law, we shall not be liable for:
- Indirect damages: Loss of profits, data, use, goodwill, or other intangible losses
- Accidental deletions: Photos, videos, contacts, or calendar events you delete using the App (even if accidental)
- Device issues: Storage problems, performance issues, or device malfunctions
- Data loss: Loss of data due to app bugs, iOS updates, device failures, or user error
- Third-party actions: Damages resulting from Apple, Firebase, Adjust, Meta, or other third-party services
6.2 Maximum Liability
In no event shall our total liability to you exceed the amount you paid for the App in the 12 months preceding the claim (or $50 USD, whichever is greater).
6.3 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.
7. Termination
7.1 Termination by You
You may stop using the App at any time by:
- Deleting the App from your device
- Cancelling your subscription (see Section 2.4)
7.2 Termination by Us
We reserve the right to:
- Suspend or terminate your access if you violate these Terms
- Discontinue the App with 60 days' notice (with pro-rata refunds for active subscriptions)
- Modify or remove features at any time
7.3 Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- Data stored locally on your device (Private Space files, analysis cache) will remain until you delete the app
- Server-side data (attribution, transaction records) will be retained per our Privacy Policy
8. Updates and Changes
8.1 App Updates
We may release updates to:
- Fix bugs and improve performance
- Add new features
- Comply with iOS changes or legal requirements
Updates may be required to continue using the App. We recommend enabling automatic updates in iOS Settings.
8.2 Changes to Terms
We may update these Terms at any time. Material changes will be notified through:
- An in-app notification
- Updating the "Last Updated" date at the top of this page
Continued use of the App after changes are posted constitutes acceptance of the new Terms. If you do not agree, you must stop using the App.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you also agree to the Privacy Policy.
10. Governing Law and Disputes
10.1 Governing Law
These Terms are governed by the laws of the United Kingdom, without regard to its conflict of law provisions.
10.2 Dispute Resolution
If a dispute arises:

- Mediation: If informal resolution fails, we agree to attempt mediation before litigation
- Jurisdiction: Legal disputes shall be resolved in the courts of England and Wales
10.3 Class Action Waiver
To the extent permitted by law, you agree to resolve disputes with us on an individual basis, and waive the right to participate in class actions or class arbitrations.
11. Miscellaneous
11.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
11.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
11.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
11.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
11.5 Force Majeure
We are not liable for failure to perform due to circumstances beyond our reasonable control (e.g., natural disasters, internet outages, iOS platform changes).
